Agreement to Our Legal Terms

We are eTime (“Company”, “we”, “us”, or “our”).

We operate the website https://etimeshop.com (the “Site”), as well as any other related products and services that refer or link to these legal terms (the “Legal Terms”) (collectively, the “Services”).

These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and eTime, concerning your access to and use of the Services. By accessing the Services, you agree that you have read, understood, and agreed to be bound by all of these Legal Terms. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.

We will provide you with prior notice of any scheduled changes to the Services you are using. The modified Legal Terms will become effective upon posting or notifying you by support@etimeshop.com, as stated in the email message. By continuing to use the Services after the effective date of any changes, you agree to be bound by the modified terms.

The Services are intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use or register for the Services.

We recommend that you print a copy of these Legal Terms for your records.

1. Our Services

The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. Accordingly, those persons who choose to access the Services from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.

We are the owner or the licensee of all intellectual property rights in our Services, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics in the Services (collectively, the “Content”), as well as the trademarks, service marks, and logos contained therein (the “Marks”).

Our Content and Marks are protected by copyright and trademark laws (and various other intellectual property rights and unfair competition laws). The Content and Marks are provided in or through the Services “AS IS” for your personal, non-commercial use only.

Your use of our Services

Subject to your compliance with these Legal Terms, including the “Prohibited Activities” section below, we grant you a non-exclusive, non-transferable, revocable licence to access the Services and to download or print a copy of any portion of the Content to which you have properly gained access, solely for your personal, non-commercial use.

Except as set out in this section or elsewhere in our Legal Terms, no part of the Services and no Content or Marks may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission. We reserve all rights not expressly granted to you in and to the Services, Content, and Marks. Any breach of these Intellectual Property Rights will constitute a material breach of our Legal Terms and your right to use our Services will terminate immediately.

3. User Representations

By using the Services, you represent and warrant that: (1) all registration information you submit will be true, accurate, current, and complete; (2) you will maintain the accuracy of such information and promptly update it as necessary; (3) you have the legal capacity and agree to comply with these Legal Terms; (4) you are not a minor in the jurisdiction in which you reside; (5) you will not access the Services through automated or non-human means; (6) you will not use the Services for any illegal or unauthorised purpose; and (7) your use of the Services will not violate any applicable law or regulation.

If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any current or future use of the Services.

4. User Registration

You may be required to register to use the Services. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.

5. Products

We make every effort to display as accurately as possible the colours, features, specifications, and details of the products available on the Services. However, we do not guarantee that the colours, features, specifications, and details of the products will be accurate, complete, reliable, current, or free of other errors, and your electronic display may not accurately reflect the actual colours and details of the products. All products are subject to availability, and we cannot guarantee that items will be in stock. We reserve the right to discontinue any products at any time for any reason. Prices for all products are subject to change.

6. Purchases and Payment

We currently accept the following forms of payment:

Cash on Delivery (COD)
Direct bank transfer

This list will be updated if we add other payment methods in future. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Services, and to promptly update this information as needed so that we can complete your transactions and contact you. Sales tax will be added to the price of purchases as deemed required by us. We may change prices at any time. All payments shall be in PKR.

You agree to pay all charges at the prices then in effect for your purchases and any applicable shipping fees. We reserve the right to correct any errors or mistakes in pricing, even if we have already requested or received payment.

We reserve the right to refuse any order placed through the Services. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order, and reserve the right to limit or prohibit orders that, in our sole judgement, appear to be placed by dealers, resellers, or distributors.

7. Return Policy

Please review our Refund and Returns Policy prior to making any purchases.

8. Prohibited Activities

You may not access or use the Services for any purpose other than that for which we make the Services available. As a user of the Services, you agree not to:

Systematically retrieve data or other content from the Services to create or compile a collection, compilation, database, or directory without written permission from us.
Trick, defraud, or mislead us and other users, especially in any attempt to learn sensitive account information such as passwords.
Circumvent, disable, or otherwise interfere with security-related features of the Services.
Use any information obtained from the Services to harass, abuse, or harm another person.
Use the Services in a manner inconsistent with any applicable laws or regulations.
Upload or transmit viruses, Trojan horses, or other material that interferes with any party’s use of the Services.
Use any automated system, such as scripts, bots, or data mining tools, to access the Services.
Attempt to impersonate another user or person.
Interfere with, disrupt, or create an undue burden on the Services or the networks connected to the Services.
Attempt to decompile, disassemble, or reverse engineer any software comprising the Services, except as permitted by applicable law.
Use a buying agent or purchasing agent to make purchases on the Services.
Collect usernames and/or email addresses of users for the purpose of sending unsolicited communications.

9. User Generated Contributions

The Services may allow you to submit product reviews, ratings, or other content (“Contributions”). Contributions may be viewable by other users. By submitting Contributions, you represent and warrant that they do not infringe any third party’s rights, are not false, misleading, obscene, defamatory, harassing, or unlawful, and do not violate the privacy or publicity rights of any third party.

We reserve the right, but have no obligation, to monitor, edit, or remove any Contributions at any time and for any reason, without notice.

10. Contribution Licence

By posting Contributions to any part of the Services, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, and display those Contributions in connection with operating and promoting the Services. You retain ownership of your Contributions, and we do not claim ownership over them.

11. Guidelines for Reviews

If you leave a product review, you agree that: (1) you should have firsthand experience with the product being reviewed; (2) your review should not contain offensive, abusive, or discriminatory language; (3) your review should not contain false or misleading statements; and (4) you should not be affiliated with a competitor if posting a negative review.

We may accept, reject, or remove reviews at our sole discretion. Reviews are not endorsed by us and do not necessarily reflect our views.

12. Advertisers

We may allow third-party advertisements, including through Google AdSense, to appear in certain areas of the Services. We provide the advertising space but have no other relationship with the advertisers, and are not responsible for the content of third-party advertisements.

13. Services Management

We reserve the right, but not the obligation, to: (1) monitor the Services for violations of these Legal Terms; (2) take appropriate legal action against anyone who violates the law or these Legal Terms; (3) restrict or disable access to any Contributions; and (4) otherwise manage the Services to protect our rights and property and to facilitate proper functioning of the Services.

14. Privacy Policy

We care about data privacy and security. Please review our Privacy Policy. By using the Services, you agree to be bound by our Privacy Policy, which is incorporated into these Legal Terms.

15. Term and Termination

These Legal Terms shall remain in full force and effect while you use the Services. We reserve the right to, in our sole discretion and without notice or liability, deny access to and use of the Services to any person for any reason, including without limitation for breach of any representation, warranty, or covenant contained in these Legal Terms or of any applicable law or regulation. We may terminate your use or delete your account and any content you posted at any time, without warning, in our sole discretion.

16. Modifications and Interruptions

We reserve the right to change, modify, or remove the contents of the Services at any time or for any reason at our sole discretion without notice. We cannot guarantee the Services will be available at all times, and we will not be liable for any loss, damage, or inconvenience caused by your inability to access or use the Services during any downtime or discontinuance.

17. Governing Law

These Legal Terms shall be governed by and defined following the laws of Pakistan. eTime and yourself irrevocably consent that the courts of Pakistan shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these Legal Terms.

18. Dispute Resolution

To expedite resolution and control the cost of any dispute, controversy, or claim related to these Legal Terms (a “Dispute”) brought by either you or us, the parties agree to first attempt to resolve the Dispute informally by contacting us at support@etimeshop.com. If a Dispute cannot be resolved informally within thirty (30) days, either party may pursue the matter before the courts of Pakistan, as set out in the Governing Law section above.

19. Corrections

There may be information on the Services that contains typographical errors, inaccuracies, or omissions, including descriptions, pricing, availability, and other information. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information on the Services at any time, without prior notice.

20. Disclaimer

THE SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOUR USE OF THE SERVICES WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTIES ABOUT THE ACCURACY OR COMPLETENESS OF THE SERVICES’ CONTENT AND WILL NOT BE LIABLE FOR ANY ERRORS, INACCURACIES, UNAUTHORISED ACCESS TO OUR SERVERS, INTERRUPTIONS IN SERVICE, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF USE OF THE SERVICES.

21. Limitations of Liability

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, OR LOSS OF DATA, ARISING FROM YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

22. Indemnification

You agree to defend, indemnify, and hold us harmless, including our officers, agents, partners, and employees, from any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of: (1) your Contributions; (2) your use of the Services; (3) your breach of these Legal Terms; or (4) your violation of the rights of a third party.

23. User Data

We will maintain certain data that you transmit to the Services for the purpose of managing performance, as well as data relating to your use of the Services. Although we perform routine backups of data, you are solely responsible for all data you transmit, and we have no liability to you for any loss or corruption of such data.

24. Electronic Communications, Transactions, and Signatures

Visiting the Services, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications, and agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communication be in writing.

25. Miscellaneous

These Legal Terms and any policies posted by us on the Services constitute the entire agreement between you and us. Our failure to enforce any right or provision of these Legal Terms shall not operate as a waiver of that right or provision. If any provision of these Legal Terms is determined to be unlawful or unenforceable, that provision is deemed severable and does not affect the validity of the remaining provisions. There is no joint venture, partnership, employment, or agency relationship created between you and us as a result of these Legal Terms or your use of the Services.
